TERMS & CONDITIONS
These Terms & Conditions (“Terms”) apply to all bookings made with Mark Hurst Photo. By confirming a booking, the client agrees to the following:
1. Booking, Deposit & Payment
A non-refundable deposit of 25% is required to secure your booking. No booking is confirmed until the deposit is received and acknowledged.
• For commercial photoshoots, Mark Hurst Photo operates a NET30 policy.
• For weddings, the full balance is payable 28 days before the wedding date.
• For family shoots, the full balance is payable before the shoot date.
• Special events may have other timeframes, which will be communicated before the event.

2. Cancellations & Rescheduling
Cancellations made by the client more than 14 days prior to the agreed date will not incur further charges beyond the deposit.
Cancellations made within 48 hours of the agreed date will be charged in full.

Mark Hurst Photo will make every reasonable effort to accommodate reschedule requests, however new dates are subject to availability.
If your reschedule request is successful and agreed, your deposit will carry over. Should Mark Hurst Photo not be able to attend your new date, the deposit will not be returned.
3. Client Responsibilities
It is the clients responsibility to:
• Ensure all relevant permissions and access are arranged.
• Communicate any key people, moments, or expectations in advance.
• Provide accurate event information and timings.
• Obtain releases and permissions.

4. Image Delivery
Images will be provided via an online gallery. Every effort will be made to ensure your photos are available in a suitable timeframe.
Standard delivery is 2-4 weeks unless otherwise stated.
Editing (minor touching up and colour correction) are included as standard. Additional or heavy editing may incur an additional charge.
5. Usage & Copyright
All images remain the copyright of Mark Hurst Photo.
Clients are granted a non-exclusive, non-transferable license for personal and/or business use as agreed in writing.
Images may not be altered (including ‘filters’), sold, licensed, or distributed to third parties without written consent from Mark Hurst Photo.
Commercial or promotional use (e.g. advertising, print, social) must be discussed and agreed upon in advance. Additional licensing may incur additional charge.
6. Watermarking
Images provided to individuals, artists or attendees of an event may be watermarked unless otherwise agreed.
Clients who have booked the session (e.g. event organisers) will receive unwatermarked images.
7. Data Protection

8. Image Storage
Images are stored securely, encrypted and backed up for future access.
While all care is taken to preserve and store images, Mark Hurst Photo does not guarantee indefinite storage unless a specific archive agreement is in place.
9. Safeguarding
When working with children or vulnerable individuals, Mark Hurst Photo will:
• Provide a valid DBS certificate/number.
• Provide proof of liability insurance.
• Never work one-on-one in unsupervised environments.
• Follow all school or organisation safeguarding policies.
• Ensure written consent is obtained for any promotional image use.

10. Limitation of Liability
In the unlikely event of equipment failure, illness, or unforeseen circumstances beyond control, liability is limited to a full refund or a rescheduled shoot.
Mark Hurst Photo will not be held liable for missed images due to lack of information, restricted access, or event conditions beyond reasonable control.
11. Social Media & Promotion
Unless otherwise agreed in writing, Mark Hurst Photo may use selected images for promotional purposes, including on social media, website, and print materials.
Clients may opt out of this at the time of booking.
12. Acceptance of Terms
By paying a deposit and securing a booking, the client agrees to these terms in full.
